Payments & Responsibilities of the Client side Organiser

Our My Ultimate Hens Consultants are here to help you create Hens memories that will last a lifetime, and to make sure that everyone who experiences a My Ultimate Package has the best possible experience. It is a requirement that the Initial Booking Representative, The Lead Hen, Organiser or Group Leader, (whom from here on in will be referred to as the organiser) is responsible for and aware that:

•  An initial deposit is payable upon a booking request being made. This deposit is subject to our cancellation policy and will be a equal to 4 participant payments for both Single day and Multi day events. This deposit secures your event on your chosen date and at your chosen time, as discussed with your hens consultant. Please note the only way to secure your My Ultimate Hens event is to pay your deposit. It is important that you understand we do not accept or agree to tentative bookings or placing events or venues on hold pending payment. We pride ourselves on being able to give you a 100% commitment that once your deposit is paid in full to us, your booking is secured and your event guaranteed with our suppliers at the time, date and Venue you require.

Please note: Of course, before we are able to 100% confirm your potential booking, we will always check the up to the minute availability with each supplier involved in your booking to avoid any disappointments. This final check occurs after receiving your credit card details for the deposit of your potential booking and BEFORE we place any charges against it. We will endeavour to make this check as soon as possible after receiving these details to confirm your event and will get back to you as an absolute priority with your confirmation documents and your 6 digit booking number – the timing for this stage will depend on how quickly we can contact each supplier manager and get a confirming reply from them - rest assured we are on the case ! Once all of the confirmations are in, we will charge your card and notify you with your 6 digit booking number and confirmation documents. We cannot stress highly enough that your booking is ONLY 100% confirmed and secured once we send your 6 digit My Ultimate booking number and Hens Booking Information documents. Until then your booking is only tentative, so please do not send your invitations out to the girls until you have your booking number ! Your booking is ONLY confirmed and locked in once we have physically charged your card for the deposit and have sent you your six digit My Ultimate Hens booking number and confirmation documents.

In the event that a booking is unavailable with a supplier, your card WILL NOT be charged and we will contact you ASAP with an alternate solution (different date, timing, alternate package etc). Should you wish to proceed at this point with the new arrangements, the process of a potential booking will repeat until your booking is fully confirmed. Should you, upon hearing from us that your original package that you potentially wanted to book is unavailable and decide to withdraw your potential booking with us, then we will delete your credit card details from our secure system, without charging the card, and the potential booking will not proceed.

•  The organiser is responsible for a My Ultimate package booking and responsible for ensuring that all money, forms and information due for a booking are supplied in a timely manner by all members of the group undertaking a My Ultimate event. Your due dates will be clearly outlined at the time of booking with your hens consultant and in your subsequent event documentation. If at any stage you are unsure of due dates associated with your event, it is your responsibility to contact one of our Consutlants for confirmation.
•  The approximate number of participants who will make up the group undertaking a My Ultimate event will be decided at the time of the initial booking. Final numbers are due on your Final Payment Due Date which will be clearly stiplulated at the time of booking, as above, and is usualy 3 weeks prior to the event. If the number of participants changes after this time additional fees may apply. All My Ultimate events have minimum participant number requirments as shown in your event documentation. This will affect the overall cost of your My Ultimate Package. In circumstances where your group falls below these required numbers the minimum amount payable for your event will still apply in all cases. i.e the minimum number of participants times the cost per head, as shown on your event documentation
•  Dates and events are confirmed upon payment of the deposit however the final Package go ahead will not be confirmed until all monies have been received.
•  The final balance for any My Ultimate Package must be paid in full on your Final Payment Due Date to avoid potential changes or cancellation of your booking.
•  Any booking for a My Ultimate Package that is initiated and made within three weeks of the My Ultimate event taking place may require full payment at the time of booking. This timing is subject to change and the My Ultimate consultant will review the specific timing of payments on a case by case basis and inform the organiser at the time of the booking request.
•  No tickets, confirmations or vouchers for the My Ultimate Package will be released to the organiser until the booking has been paid in full by each member of the travelling party (i.e all monies have been received).
•  The organiser must ensure that everyone attending My Ultimate Event is aware of the terms and conditions of My Ultimatehens
•  The organiser must be aware that the booking may be cancelled if full payment is not received by due date and any previous payments will be subject to our cancellation policy.
•  The organiser is responsible for ensuring that all participating members of the My Ultimate Package have finalised their payments prior to the final payment due date.
•  The organiser is responsible for and acknowledges that they are providing details of all guests participating in a My Ultimate Package, including but not limited to names, dietary requirements, fitness levels, special needs, payment specifications, group requirements etc. and that the My Ultimate Consultant will pursue the booking request and offer advice based on the information supplied by the organiser. The organiser acknowledges that they are responsible for providing true and accurate information to My Ultimate at the time of booking. Any misinformation provided by the organiser that impacts the My Ultimate Package will be at the responsibility of the organiser and not the My Ultimate Consultant.

Agency:

My Ultimate Pty Ltd acts as an event booking agent only. We sell various event related products on behalf of numerous short term transport, accommodation and other wholesale event service providers. My Ultimate Pty Ltd’s obligation is to make event bookings on your behalf and to arrange relevant contracts between you and multiple event service providers. Whilst the highest care is taken by My Ultimate Pty Ltd to work with the highest quality event service companies, we have no responsibility for these services nor do we make or give any warranty or representation regarding their standard. All bookings are made subject to the terms and conditions and limitations of liability imposed by these individual event service providers. Please be aware that a specific My Ultimate Package may be made up of several service providers. Your legal recourse is against the specific provider and not My Ultimate Pty Ltd. If for any reason, an event service provider is unable to provide the services for which you have contracted your remedy lies against the provider and not with My Ultimate Pty Ltd.

Event Documents:

Event documents include (without limitation) activity tickets, hotel vouchers, event vouchers or any other document (whether in electronic form or otherwise) used to confirm an arrangement with an event service provider. Event documents may be subject to certain conditions and/or restrictions including (without limitation) being non-refundable, non-date-changeable and subject to cancellation and/or amendment fees. All event documents pertaining to activity tickets, hotel vouchers and the like are non transferable. All activity tickets must be issued in the name of the photo identity holder, some event services will deny carriage or supply of services if the name varies and the booking may be cancelled. It is your responsibility to collect all event documents from us prior to your event. Please note that some venues require proof of identity for admission under their current requirements. You will be notified if this is the case in your event documentation.

Event Insurance:

We cannot legally provide information to you about individual event insurance policies or companies.

Cancellation Fees:

Here at My Ultimate we pride ourselves on running our business with intergrity and transparency of our booking policies. By the time you make a booking for your event with us your constultant and the information provided to you will have clearly stipulated that all booking deposits are always 100% non-refundable.

Cancelled bookings will always incur charges. As we are acting as an agent our cancellation policy is in addition to the cancellation policies of the suppliers we work with to faciliate your package. Any cancellation of an event will always result in the 100% loss of your booking deposit. Additionally, cancellation within three weeks of your event date will incur further charges - My Ultimate will impose a 30% cancellation fee of gross charges excluding deposit (i.e the minimum number of persons required for your chosen package times the per head cost of your chosen package, less the deposit already paid). My Ultimate fees will apply in addition to any service provider fees incured by My Ultimate pertaining to your event, that will be passed on. This may be up to 100% of the gross cost of your event.

Some fees may also apply where a booking is changed or vouchers are reissued at any stage following the payment of your booking deposit - if applicable these will be clearly discussed with you by your hens consultant at the time of the requested change.

Limitation of Liability:

Under no circumstances will My Ultimate Pty Ltd and its trading name myultimatehens, or any other party involved in the creation, production, maintenance or distribution of myultimatehens.com.au, be liable for any damages either direct, indirect, incidental, special or consequential (including but not limited to loss of: profits, business, anticipated savings, goodwill, opportunity, use of data or other intangible losses) that result from any of the following :

•  the use of and reliance upon myultimatehens.com.au;
•  any inability to use myultimatehens.com.au;
•  any errors, omissions, interruptions, suspension, termination, deletion of files or email, mistakes, defects, viruses and other harmful creations, delays in operation, transmission or service response time, or any failure of performance by myultimatehens.com.au including without limitation those arising from acts of God, communications failure, theft, destruction or any unauthorised access to myultimatehens.com.au data, records, programmes or services;
•  any services or products, information or advice received through or advertised on myultimatehens.com.au or through any links provided on myultimatehens.com.au

My Ultimate Pty Ltd does not accept any liability of whatsoever nature, whether in contract, tort or otherwise, for the acts, omissions or default, whether negligent or otherwise, of third party providers over whom we have no direct control. Under circumstances where liability cannot be excluded, such liability is limited to the value of the purchased event arrangements. We do not accept any liability in contract, tort or otherwise for any injury, damage, loss (including consequential loss), delay, additional expense or inconvenience caused directly or indirectly by force majeure or any other event which is beyond our control which is not preventable by reasonable diligence on our part.
If any jurisdiction doesn’t allow the exclusion or limitation of liability for consequential or incidental damages, liability is limited to the fullest extent permitted by law.

Jurisdiction and Governing Law :

These conditions shall be governed by and construed in accordance with the laws of Australia. As myultimatehens.com.au can be accessed from other places around the world with different laws from those of Australia, when you access myultimatehens.com.au you agree that the laws of Australia will apply to all matters relating to your use of myultimatehens.com.au.
